Atlanta Dream Marketing Alerts Terms and Conditions

The following terms and conditions ("Terms") apply to the Atlanta Dream Marketing Alerts offered by Dream Pursued LLC and its subsidiaries and affiliates (collectively, "Atlanta Dream" or "we," "us" or "our"). By opting into the Atlanta Dream Marketing Alerts, you agree to these Terms, our Privacy Policy and our Terms of Use, which are hereby incorporated by reference. If there is a conflict between the Terms of Use and these Terms, these Terms apply.

Atlanta Dream Marketing Alerts

We send correspondence, to users who opt into Atlanta Dream Marketing Alerts, for all Atlanta Dream SMS marketing campaigns, which may consist of marketing text messages, including information related to promotions, special offers, and events (the "Atlanta Dream Marketing Alerts"). Message frequency varies. Opting into Atlanta Dream Marketing Alerts is optional, and your enrollment is not a condition for purchase.

Enrollment

You can opt into the Atlanta Dream Marketing Alerts by adding your mobile number when prompted on or through form submissions, and then checking a box agreeing to receive Text Messages, on the Atlanta Dream website, or by following other instructions we may publish in the future. By enrolling in the Atlanta Dream Marketing Alerts, you are providing (and signing) your prior express written consent to receive recurring marketing text messages from us (each, a "Text Message"), including Text Messages that may be sent using an automatic telephone dialing system and/or AI-assisted technology, to the mobile phone number you provided when enrolling and/or any other mobile phone number you designate. You understand and agree that you are subscribing to receive recurring Text Messages, not a single, one-time message, and that the frequency of messages will vary.

Changes to Mobile Phone Number and Indemnification

By participating in the Atlanta Dream Marketing Alerts, you represent that you are the account holder for the mobile phone number(s) you provided and that you are a United States resident 18 years of age or older. You are responsible for completing the opt-out process or notifying us immediately if you change, transfer, or intend to stop using the mobile phone number(s) used to participate in the Atlanta Dream Marketing Alerts. You may notify us of a number change by calling us at 770-430-7715. Your agreement to do so is a material part of these Terms.

You agree to indemnify us for all claims, expenses and damages related to or caused in whole or in part by your failure to complete the opt-out process or notify us if you change, transfer, or intend to stop using the mobile phone number(s) used to participate in the Atlanta Dream Marketing Alerts, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.

Personal Data

Data obtained from you in connection with your participation in the Atlanta Dream Marketing Alerts may include your mobile phone number, your mobile carrier's name, and the date, time, and content of your text messages. We may use this information in accordance with our Privacy Policy to contact you and to provide the services you request from us.

Cost

We do not charge a fee to participate in the Atlanta Dream Marketing Alerts. Message and data rates may apply (please contact your mobile carrier for details). Under no circumstances will we or our affiliates be responsible for any text messaging or wireless charges incurred by you or by a person that has access to your wireless device or telephone number.

Opt-Out

You can withdraw your consent to receive Text Messages through the Atlanta Dream Marketing Alerts at any time by texting STOP to +17708092438 or as a reply to any Text Message you receive from us, or by following other opt-out instructions we may provide from time to time. You acknowledge that our text messaging platform may not recognize and respond to withdrawal or unsubscribe requests that do not include the STOP keyword command and agree that the Atlanta Dream and its service providers will have no liability for failing to honor such requests. You can also withdraw consent by sending an email to dataprivacy@atlantadream.com and including your phone number and the subject line "STOP" in the email or by calling us at 770-430-7715. If you withdraw your consent, you will receive one additional Text Message confirming you have been unsubscribed and that you will no longer receive Text Messages from us.

Disclaimers

The Atlanta Dream Marketing Alerts and all information provided in the Text Messages we send are provided to you on an "AS IS" and "AS AVAILABLE" basis and AT YOUR OWN RISK TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW. To the fullest extent permitted under applicable law, we disclaim all warranties, whether express or implied, including, without limitation, any warranties of title, merchantability, non-infringement and fitness for a particular purpose and all warranties regarding security, currency, correctness, quality, accuracy, completeness, reliability, performance, timeliness, or continued availability.

Liability

Neither the Atlanta Dream nor the mobile carriers will be liable for any delays in the receipt of, or failure to deliver, any Text Messages, as delivery is subject to effective transmission from your mobile carrier. Without limiting the generality of the foregoing, we are not responsible for cellular network or equipment performance, and you release us of any liability for claims based on hardware, software, electronic, network, or other communications malfunctions, including, without limitation, incomplete Text Messages, delayed transmissions, or any technical difficulty that may limit your ability to send or receive a Text Message.

Supported Carriers

The Atlanta Dream Marketing Alerts are designed to work with most major mobile carriers in the United States. However, not all mobile carriers may participate, and the Atlanta Dream Marketing Alerts may not be available on all carriers. We are not responsible if a particular carrier does not support the Atlanta Dream Marketing Alerts or if service is delayed, suspended, or discontinued by any carrier.

Dispute Resolution

Any controversy, claim, or dispute arising out of related to these Terms or the Atlanta Dream Marketing Alerts, including, but not limited to, alleged violations of state or federal statutory or common law rights or duties shall be solely and exclusively resolved according to the procedures set forth in our Terms of Use.

Governing Law

The Atlanta Dream Marketing Alerts and these Terms are governed by the laws of the State of Georgia, without regard to its conflict of laws principles. You agree to irrevocably submit to the exclusive jurisdiction of the state and federal courts located in Fulton County, Georgia, and waive any objection to the propriety or convenience of such venues.

Changes to Atlanta Dream Marketing Alerts

We reserve the right to make changes to the Atlanta Dream Marketing Alerts, including, without limitation, altering the frequency of Text Messages sent so as to increase or decrease the total number of Text Messages sent. We also reserve the right to change the short code or phone number from which Text Messages are sent and we will notify you when we do.

We reserve the right to modify these Terms at any time. If we do, we will publish an updated version of these Terms.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect the remaining provisions of these Terms, which shall remain in full force and effect. The invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the parties' original intent.
